ARTICLE II - RECOGNITION

3. The Company recognizes the Union as the exclusive bargaining agency for the purpose of collective bargaining for its production and maintenance employees in all its present and future plants, located within a 35 mile radius of Evansville, that are directly related to and producing parts and/or components for the Evansville Refrigeration Division, in respect to rates of pay, wages, hours of employment and other conditions of employment.

3.1 Supervisory or salaried employees shall not perform bargaining unit work except for the instruction or training of employees or when emergencies arise. The provisions of this subparagraph shall not apply to the engineering and development of new processes or equipment. "Employees" as used in this Agreement, shall not mean nor be construed to mean supervisory employees, clerical or technical employees, supervisors, assistant supervisors, watchperson, or plant protection employees as defined by the National Labor Relations Board.
